Well, it is not the first time that we’re seeing some big brands using false advertising to promote their products, and that is exactly what is happening with Poppi right now. And sure enough, their claim of “gut healthy” soda has now led to this Poppi lawsuit, and if you don’t know what became of this lawsuit, then just keep on reading. Here we go.

Poppi Lawsuit

What Is the Poppi Lawsuit All About?

Many of you may already know that Poppi was taken to court in California in 2024. Why, like what really led to this? VNGR Beverage, LLC, the company that makes Poppi, was the recipient of a complaint for deceptive advertising. The primary issue in the suit was the “gut healthy” allegation, with the lawsuit stating that there was insufficient scientific backing for the claim. Buyers of the product were either paying more or merely picking the brand due to the perception that it would make them healthier.

After that, in March 2025, PepsiCo bought Poppi for $1.95 billion. The legal battle was still ongoing even with the intervention of PepsiCo.

VNGR Beverage decided to resolve the issue by July 2025. The company gave no indication of guilt, yet it was decided that $8.9 million would be paid to wrap up the case. Such compromises happen quite frequently as corporations usually opt to steer clear of these types of lawsuits where it is actually their brand’s image that is on the line.

How Does the Settlement Work?

It is important for you to know the following: the settlement relates to transactions involving Poppi that were made between January 23, 2020, and July 18, 2025. Thus, if you bought Poppi within this period, a payout could be available to you.

  • Single can: $0.75 back
  • Four-pack: $3 back
  • Eight-pack: $6 back
  • 12-pack or 15-pack: $9 back

One can file a complaint without having receipts, but the maximum amount will be limited to $16 for a household. However, it is better to have receipts so you can claim more, which will be based on the actual purchases made. In addition, there will be a $5 minimum for every household.

How to File a Claim

To receive the settlement, you must file a claim before September 26, 2025. Claims can be submitted in two ways:

By far, we know that the settlement shall be looked at in a last court hearing on the 20th of November 2025. In case it is accepted, the money will probably be sent at the beginning of 2026, which is the normal time (within 90 days) after an approval is made.

And What Is In It For You As a Citizen Of This Country? Huh? Well…

This case is an example of a situation that shows why companies cannot claim health benefits for their products without providing sufficient evidence. Phrases such as “gut healthy” are attractive to the ear, but if there is no scientific support, they may deceive customers.

Moreover, this is a depiction of the legal side of business that corporations, even the giants, have to consider as a result of their purchases. Despite being a big deal worth $1.95 billion, PepsiCo had to take care of this $8.9 million settlement related to the brand in addition to the acquisition of Poppi.

For customers, this is a signal to continue being sceptical of the information provided on food and beverage labels. Advertising may be smart, but the truth counts more than catchy phrases.
