What Happened in the Fidelity Data Breach
The incident occurred between August 17 and August 19, 2024. According to the official settlement materials, an unauthorized third party accessed Fidelity’s computer network and obtained certain information.
The information potentially exposed varied by person. It may have included names, Social Security numbers, financial account information and driver’s license information. The lawsuit concerned allegations about Fidelity’s protection of customer information.
The case is In re Fidelity Investments Data Breach Litigation, No. 1:24-CV-12601-LTS, in the United States District Court for the District of Massachusetts. The defendants are FMR LLC and Fidelity Brokerage Services LLC, both doing business as Fidelity Investments. Fidelity denies wrongdoing and agreed to settle to avoid the expense and uncertainty of continued litigation.
Who Qualified for the Settlement
Eligibility was limited to the defined settlement class. Having a Fidelity account alone did not qualify someone for payment.
The class includes individuals in the United States whom Fidelity notified of the incident under relevant state law before the settlement’s notice deadline. It also includes other individuals in the United States whose financial account number and routing number were exposed in the incident.
The agreement estimated approximately 155,000 individuals or joint accountholders within the class. This is broader than reports referring only to roughly 77,000 people who initially required breach notification.
Where joint accountholders shared a single compromised account number and routing number, only one claim was permitted. People who validly excluded themselves from the settlement were not eligible for benefits.
How Much Could Eligible Customers Receive
The settlement offered several benefits, subject to a valid claim and the applicable requirements.
Documented losses of up to $5,000. Claimants could seek reimbursement for actual out-of-pocket losses linked to the incident and incurred between August 17, 2024, and July 27, 2026. Examples included identity theft or fraud losses, credit monitoring expenses, replacement identification costs and certain expenses incurred while addressing the incident.
Supporting records were required. Receipts or bank statements could establish the amount and connection to the breach. Personal notes could support other evidence but were insufficient on their own. Expenses already reimbursed by another party could not be claimed again.
Cash payment estimated at $100. Class members could request a pro rata cash payment without documenting a financial loss. Pro rata means the available money is allocated proportionally under the settlement rules. The $100 estimate could increase or decrease depending on claims and available funds.
California payment estimated at $50. California class members could also request a payment connected to the California Consumer Privacy Act claims. That amount was subject to adjustment.
Credit monitoring and identity protection. The settlement offered two years of CyEx Financial Shield Complete, including monitoring and financial fraud insurance. The insurance coverage is separate from a direct settlement cash payment.
Why the Full Fund Is Not Distributed as Cash
The $2.5 million is the total settlement fund. Court-approved legal fees, litigation expenses, administration costs and service awards are paid from it before the remaining money funds class benefits.
The notice described a request for attorneys’ fees of up to one-third of the fund, reimbursement of litigation costs up to $45,000 and service awards of $2,500 for each class representative. Those requested amounts required court approval. Claimants should not calculate their payment by simply dividing $2.5 million by the number of affected customers.
Claim Deadline and Submission Rules
The deadline to submit a claim online or have a mailed claim postmarked was July 27, 2026. The deadline to opt out or object was June 26, 2026. The administrator’s calendar listed the final approval hearing for July 9, 2026.
During the claim period, customers could submit the official online form or mail a completed paper form. A timely claim was necessary to receive benefits. Receiving a breach notice alone did not trigger an automatic payout.
The claim portal now states that the deadline has passed. Anyone who missed it should ask the administrator whether any court-authorized exception applies rather than assume an old claim form remains usable.
Checking a Fidelity Settlement Payment
The official FAQ describes payments as following final approval and the resolution of any appeals. It does not provide a fixed distribution date. The July 9 hearing date should not be treated as a promised payment date.
Customers who submitted claims should retain their confirmation and contact the administrator with their claim reference. They can ask whether the claim was received, whether further information is needed and how to correct contact or payment details.
The settlement agreement provides for checks or electronic payments. Its terms state that checks must be cashed within 90 days of issuance. A payment notice should therefore be checked promptly.
